Client Rights & Consumer Information

Soulera Counseling, PLLC is committed to protecting client rights, privacy, and confidentiality. In accordance with Texas House Bill 4224 and Section 181.105 of the Texas Health and Safety Code, the following information explains how clients may request records, contact the licensing authority, and file a consumer complaint.

Requesting Your  Counseling Records

Clients have the right to request access to their counseling records as permitted by Texas law.

How to request records:
• Submit a written request by email only to your your counselor's email or info@souleracounseling.com
• Include your full name, date of birth, the records you are requesting (dates or description), and your signature
• Indicate whether you are requesting a copy or a summary of records and the reason for requesting

Requests are reviewed and responded to within the timeframes required by Texas law. Fees may apply as allowed by law.

Important limitations on record release:
Counseling records are not automatically released in all circumstances. As a Licensed Professional Counselor, I am legally and ethically required to protect client safety, confidentiality, and the privacy of others. Under Texas law and professional ethics, access to records may be limited or denied in certain situations, including but not limited to:

• If releasing the information could reasonably be expected to cause serious harm to the client or another person

• If the records contain confidential information about another individual that cannot legally be disclosed

• If the records are protected by law due to court involvement, forensic evaluations, or legal proceedings

• If the request involves psychotherapy notes, which are not part of the designated medical record and are not released

If access to any portion of a record is limited or denied, you will be informed in writing and provided with an explanation consistent with Texas law. When appropriate, records may be released to another qualified mental health professional at your request.

Filing a Consumer Complaint

Consumers may also file a complaint with the Texas Office of the Attorney General – Consumer Protection Division.

Confidentiality, Legal Matters, and Subpoenas

Client information and counseling records are confidential under Texas law and the Texas Behavioral Health Executive Council (BHEC) rules.

Information may only be disclosed without client authorization when legally or ethically required, including but not limited to:

• Imminent risk of serious harm to the client or others
• Suspected abuse or neglect of a child, elderly person, or disabled individual
• A valid court order or subpoena
• Licensing board investigations or legal proceedings

If records are requested through legal means (such as a subpoena), records are not automatically released. Requests are reviewed carefully, and disclosures are limited to what is legally required. When possible, clients are notified of legal requests involving their records.
